These Terms govern the use of Domo ("the Service"), a church
management platform available at domoiglesia.com. By creating an account or using
the Service, the church and its users ("you", "the Customer") accept these Terms and the
Privacy Policy.
The Service is provided by Enrique Oriolo, an individual sole proprietor (monotributo) registered in Argentina, Tax ID (CUIT) 20-35165631-0, with address at Calle 473 N° 2712, Piso 1, Dpto 5, City Bell (1896), Provincia de Buenos Aires, República Argentina ("Domo", "we"). Domo provides tools to manage a church's member directory, groups, ministries, events, attendance and pastoral care. Each church operates in an isolated space with its own database.
The Customer is responsible for the accuracy of registration data, the confidentiality of its credentials, and the activity of the users it creates. You must notify us immediately of any unauthorized use. The Service is intended for adults with authority to contract on behalf of the church.
The Service is offered with a free trial period. After the trial, continued use requires an active paid plan. Prices and limits for each plan are disclosed at sign-up and may change with prior notice. Payments are processed through our billing provider. Non-payment may lead to suspension of access and, subsequently, account termination under Section 8.
The Service is billed per period (monthly or annual) and renews according to the chosen plan. Unless otherwise required by law, amounts already paid are non-refundable and not pro-rated for early cancellation within a current period: upon cancellation, the Service remains active until the end of the paid period and no further charges are made. Where your local law grants a right of withdrawal, we honor it as that law provides.
You may not use the Service for unlawful purposes, upload content that infringes third-party rights, attempt to breach the security or isolation between accounts, or resell the Service without authorization.
Data uploaded by the Customer (including data of the people in its community) is and remains the Customer's property. The church acts as the controller of that data; Domo processes it on the Customer's behalf to provide the Service, as a data processor, under the Privacy Policy and the Data Processing Addendum (DPA), which is part of these Terms.
The Customer represents and warrants that: (a) it has a lawful basis and, where required, the consent of data subjects to upload and process each data item, including sensitive data (e.g. health or family notes) and minors' data, for which it warrants having the consent of those holding parental authority; (b) it is the party responsible to data subjects for their rights; and (c) it complies with applicable data protection law.
We may suspend the Service for non-payment or breach of these Terms. The Customer may request termination at any time. After termination, a reasonable window is offered to export the data before its permanent deletion, as described in the Privacy Policy and the DPA.
We work to keep the Service available and to run periodic backups, but the Service is provided "as is" and "as available", without warranty of uninterrupted or error-free operation. We may perform scheduled maintenance. Nothing in this section limits rights the law grants you on a mandatory basis.
To the maximum extent permitted by law, Domo shall not be liable for indirect, incidental or consequential damages, or for lost profits, lost data or lost opportunities. Our total aggregate liability, on any basis and under any theory of liability (contract, tort, strict liability or otherwise), is limited to the greater of: (a) the amounts actually paid by the Customer in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100). This limitation survives even if a remedy fails of its essential purpose, and does not apply where the law does not permit it (e.g. willful misconduct).
The Customer will indemnify and hold Domo harmless from third-party claims (including data subjects and authorities) arising from the content it uploads, the lack of a lawful basis or consent to process it, or breach of these Terms, bearing reasonable defense costs.
Domo is an organizational tool. It does not provide pastoral, spiritual, psychological, medical, legal or accounting advice. Any decisions the church makes based on information from the Service (including follow-up lists, statistics or reminders) are its sole responsibility. Domo does not warrant the accuracy or completeness of data uploaded by the Customer.
The Service relies on third-party providers (hosting, email and payments). Domo is not liable for interruptions, delays, losses or damages caused by the failure, change or suspension of those third parties, nor for the content of external linked sites.
Domo shall not be liable for failures or delays caused by events beyond its reasonable control, including power or internet outages, provider failures, natural disasters, conflicts, acts of authority or connectivity restrictions.
Although we run periodic backups, the Customer is responsible for keeping its own copies using the available export features. Domo does not act as the sole or exclusive custodian of the Customer's information.
These Terms, together with the Privacy Policy and the DPA, constitute the entire agreement between the parties. If any clause is held invalid, the remaining clauses remain in full force. Failure to exercise a right is not a waiver of it. The Customer may not assign this agreement without our consent; Domo may assign it to a business successor. Notices are sent through the registered contact channels.
We may update these Terms. Material changes will be communicated through the registered contact channels. Continued use after notice implies acceptance.
These Terms are governed by the laws of the Republic of Argentina. Any dispute shall be submitted to the competent ordinary courts of the provider's domicile, without prejudice to the rights that mandatory consumer-protection rules grant the Customer in its jurisdiction.
